The Court of Appeal decision does not appear to have been reported. This
is probably because its decision seems to have been to stay the
proceedings and refer the case to the European Court of Justice (ECJ)
for a preliminary ruling. 
 
The notice about the reference for a preliminary ruling was published in
Official Journal C 197, 8 December 2007, p.20 (OJ C available on the
EUR-Lex website at http://eur-lex.europa.eu/JOIndex.do?ihmlang=en)
 
The ECJ registered the case as number C-420/07. The ECJ's preliminary
ruling was handed down in April this year and reported in The Times on 1
May 2009. There is a fuller report on the EUR-Lex website at
http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=CELEX:62007J0420:E
N:HTML  (it won't appear in the printed European Court Reports for a
couple of years).
 
The HM Court Services Casetracker facility currently indicates that the
Court of Appeal is going to continue the hearing later this year - see:
